- A minimum commitment period of 12 consecutive months (initial period) is required.
- This Lease Agreement is only available for Advance plan subscriptions.
- Nixplay will dispatch the Hardware once payment is received and deliver to the Client’s primary location at no extra cost.
- Nixplay shall at all times retain ownership and title to the Hardware.
- Nixplay will repair any hardware defects using new or refurbished replacement parts. If the Hardware cannot be repaired, Nixplay will replace it with a new or refurbished unit. The replacement model may or may not be the same size as the original unit depending on stock availability.
- Clients shall keep the Hardware in good and marketable condition and operate it with due care.
- Clients shall be liable for the cost of repairs or replacements due to any and all loss, theft or damage to the Hardware.
- Clients will not sell, pledge or in any way charge the Hardware by way of security while the Hardware remains the property of Nixplay.
- Clients shall not, without prior written consent of Nixplay, transfer the possession of, or sublease, the Hardware to any other third party.
- At the end of the initial period, Clients will have the option to renew the Lease Agreement for an additional 12-month period. Written notice of renewal shall be sent to Nixplay 30 days prior to the expiration of the current Lease Agreement period.
- If Clients do not wish to renew the Lease Agreement, written notice of termination shall be given to Nixplay 30 days prior to the expiration of the current Lease Agreement.
- Upon termination, Nixplay reserves the right to request the return of the Hardware to its designated return location within 3 weeks following termination in the same delivered condition, reasonable wear and tear excepted, and the Client will pay the shipping and handling charges.
- In the event of early termination by Clients before the end of the committed initial period, Clients will be liable to pay the monthly fee for the remaining months of the committed initial period and shall immediately return the Hardware to the designated return location at Client’s cost.
- In the case of any disputes, Nixplay reserves the right of final decision on the terms and conditions of this offer.
